About Mercedes Emissions Scandal

The Mercedes emissions issues came to light in 2017 following a ‘voluntary service action’ from Daimler, applying software updates to vehicles across Europe. The recall has affected over 3 million diesel vehicles so far and over 40 models, and you can check for more eligibility information here.

The recall stems from the alleged use of technology that could amount to a ‘defeat device’, allegedly to trick emissions tests. The German regulator, the KBA (German Federal Motor Transport Authority), reportedly found that some diesel engines were not complying with European emissions regulations, although the carmaker continues to deny any wrongdoing.

Emissions scandals can be extremely dangerous as they can allow the release of high levels of toxic gases such as NOx into the atmosphere. Emissions regulations are designed to keep toxic emissions released by cars as low as possible. If a car manufacturer like Mercedes breaks the rules on such a large scale, it could have a toxic impact on the environment.

The Car Emissions lawyers are representing people pursuing claims against Mercedes for elements that include the following:

  • Claims in deceit against the manufacturer;
  • Breaches of contract against the dealership and / or against the manufacturer financier;
  • Breaches of the (amended) Consumer Protection from Unfair Trading Regulations 2008 (“CPUT”) against the dealership and /or the manufacturer financier.

Where CPUT (Consumer Protection from Unfair Trading) regulations apply, claimants could be eligible to receive up to 100% of the purchase price of the vehicle.
