We have been accepting Mercedes emissions compensation claims for some time now, but if you’ve yet to start a case, here’s how we can help you.

When the Volkswagen emissions scandal broke in 2015, we felt there would be other manufacturers that would also need investigating. Since then, several carmakers have been involved in legal actions and have faced criminal investigations around the world. Whilst many continue to defend themselves and state that they have done nothing wrong, we believe that there’s justification for further action.

In 2015, the Car Emissions Lawyers (that’s us) were one of the first – if not the first – to formally accept VW cases on No Win, No Fee agreements. We were also the first to pioneer High Court action in January 2016, and we were appointed to the Steering Committee for the VW action in 2018. In 2020, we’re taking new cases forward as part of the Mercedes emissions compensation action.

Mercedes emissions compensation action

We are accepting cases for Mercedes emissions compensation claims in the same way we have done for VW cases where we acted for thousands of owners.

First and foremost, if you are a Mercedes owner that has been involved in a recall that is related to emissions, we may be able to help you. The recalls actually date back to 2017 and involve a number of diesel models. There are also questions over whether Mercedes AdBlue technology is compliant with the law, and we intend to find out as part of the action that we are taking.

For more information about the recall and the action, please see the specialist advice page here.

If you are eligible to join the compensation action, we may be able to represent you for a case on a No Win, No Fee basis. As huge believers in access to justice, we have been working in this way for thousands of clients for many years. With this kind of arrangement in place, what have you got to lose in making a claim?

What is the compensation action for?

The Mercedes emissions compensation action is for anyone whose diesel vehicle may be emitting more dangerous NOx than it should be doing. The VW emissions scandal highlighted that there are ways in which software can be used to make vehicles look more NOx efficient then they are. Where such software amounts to a “defeat device”, action needs to be taken.

If it is established that Mercedes models contain software or technology that can amount to a “defeat device”, we will be looking to settle claims for compensation for owners. Mercedes (Daimler) deny any wrongdoing, but the KBA (German Federal Motor Transport Authority) stated in court papers that certain diesel engines may not be complying with European emissions standards. If models are polluting more NOx that is dangerous to both human health and the environment than they should be, justice needs to be served.

To do this, a compensation action can be used to ensure that owners receive damages as the value of their vehicles may be affected. Some legislation can also allow owners to receive a percentage back of the purchase price as well. In turn, this serves to punish the offending carmaker for their wrongdoing.
