What is the compensation action for?
The Mercedes emissions compensation action is for anyone whose diesel vehicle may be emitting more dangerous NOx than it should be doing. The VW emissions scandal highlighted that there are ways in which software can be used to make vehicles look more NOx efficient then they are. Where such software amounts to a “defeat device”, action needs to be taken.
If it is established that Mercedes models contain software or technology that can amount to a “defeat device”, we will be looking to settle claims for compensation for owners. Mercedes (Daimler) deny any wrongdoing, but the KBA (German Federal Motor Transport Authority) stated in court papers that certain diesel engines may not be complying with European emissions standards. If models are polluting more NOx that is dangerous to both human health and the environment than they should be, justice needs to be served.
To do this, a compensation action can be used to ensure that owners receive damages as the value of their vehicles may be affected. Some legislation can also allow owners to receive a percentage back of the purchase price as well. In turn, this serves to punish the offending carmaker for their wrongdoing.
