If this defeat device essentially allowed vehicles to pass testing whilst polluting way more emissions outside test environments, they may be in breach of the law.
The next part is then about any entitlement to claim compensation arising from a breach of the law. If any owner or former owner has suffered any form of losses or expenses, this can be something to claim for right away. This could be loss of residual value to the vehicle arising from the fact it has a defeat device in it. However, there may also be claims in deceit where you could claim damages for being the victim of deceit itself, and some people may be able to claim using the Consumer Protection from Unfair Trading Regulations (CPUT).
