If so, it may be the case that the vehicles are polluting more dangerous NOx than expected, with models passing emissions testing when they shouldn’t be.

The parent company for Mercedes, Daimler, disputes that they have done anything wrong. However, you may be aware that Volkswagen did the same thing and, just recently, the technology that they used was established to be a defeat device in the High Court of Justice.

Further, VW’s attempt to appeal this key decision was refused.

We can only compare the two emissions issues to some extent. Just because the court cases against VW are progressing in favour of the Claimants doesn’t mean the same will happen for Mercedes, as it will depend on how any alleged software or technology works. We can take positives from the VW decisions in general, and we can also look to settlements and court decisions in the US and Germany as well.
