Mercedes emissions claims settlement

A Mercedes-Benz Canadian class action has reportedly settled on a provisional basis in the sum of $243m to account for some 80,000 owners who have joined the claim.

In terms of the wider fight for global justice arising from allegations of emissions cheating and deception, this looks to be another positive step forward. It is understood that a hearing is set to take place this week where the court may then be able to approve the provisional settlement made, and we will be keeping an eye on developments.

Settled: Mercedes-Benz Canadian class action

It was reported toward the end of last year that a major Mercedes-Benz Canadian class action had settled on a provisional basis for the sum of $243m.

According to the Toronto Star, the Mercedes-Benz Canadian class action that has provisionally resolved involves some 83,000 owners of diesel vehicles in the country. It is understood to have been for vehicle years between 2009 and 2016 and that the action involves the recall of vehicles that are affected. It may also include cash payments for those whose vehicles have not been recalled as well as buyback schemes like we saw in the US settlements as well.

The settlement has not yet been approved, but a hearing is understood to be taking place this week that may see the approval go through.

What this means for the actions in England and Wales

We regularly report on emissions compensation settlements around the world as part of the wider fight for justice for the millions affected by alleged emissions cheating. The Mercedes-Benz Canadian class action does not have any direct bearing or influence on the legal actions taking place in England and Wales given that we are operating in separate legal jurisdictions. This means that the decisions abroad are being based on different laws and, although some can be similar, they are not usually all the same.

That being said, it is another positive step forward in the global fight for justice. Although we are working in different jurisdictions, a unified approach can still be beneficial, and we are pleased to see this latest provisional settlement.

We look forward to further settlements taking place, including (hopefully) in England and Wales where we operate. Our legal systems here are, unfortunately, known to be quite slow, so we are not quite at the stage of settlement yet. First, we must prove that the allegations made are true, as carmakers continue to strongly deny that they have done anything wrong. This is despite settlements like those in the Mercedes-Benz Canadian class action and elsewhere.
