Volkswagen Emissions Scandal recall finally begins

A common question in the lips of the many thousands of people we act for has been: “when will the Volkswagen recall begin?”

We’ve all been waiting very patiently since the German automotive giants suggested it would begin in January this year, but until now, we’ve all had to be very patient!

Clients are now advising us that they have received more letters asking them to book their vehicle in for the recall, so it looks like it’s finally begun.

The recall begins – but what happens next?

We already have data from investigative research that outlines the effects the recall will have on vehicles. Unfortunately they may be significant.

We’re talking:

  • Higher fuel consumption
  • Reduced engine performance
  • Increased pressure on DPF filters

The reason for this is that the engine management systems designed to reduce NOx typically achieve this by making the engine perform inefficiently. Whilst this handily reduces NOx emissions to within legal limits, it also leads to reduced engine performance and higher fuel consumption because the engine is working in an inefficient way.

A concept known as “soot-NOx” trade off simply means that you can’t lower one without increasing the other; i.e. lower NOx means higher carbon emissions, and vice-versa.

Unfortunately, the reality is that the VW recall is going to have an adverse affect on the vehicle, which is part of the basis of the claims we’re making for people.

Does this mean VW will compensate UK victims?

We see no reason why they shouldn’t compensate UK victims, and we remain confident that Volkswagen don’t have a leg to stand on in terms of any defence they propose.

It’s worth remembering that they must have decided to cheat in the first place for some “important” reason for them. We suspect it’s because of the impact adhering to NOx emissions has on things like fuel consumption and engine performance, and we all know that VW group cars are often known for their performance and efficiency.

VW say the recall won’t affect my vehicle – is this true?

Based on the evidence we have obtained to date, as well as deductive logic, we cannot see how such a statement can be accurate at all. Science says what the impact will be, and if they could have adhered to the NOX regulations in the first place, then why didn’t they? Why cheat in the first place?

They’re suggesting people will not suffer any loss but we can’t see how this is possible in any way shape or form.

Should I go for the recall?

We can’t advise on this at the moment unfortunately – it’s ultimately up to you; but either way, there will be an impact on the vehicle from what we are being advised, and from what we know so far.
