Mercedes-Benz Emissions

Our expert lawyers have been contacted for help in relation to Mercedes emissions software updates that are being applied to vehicles in the UK and across Europe through parent company Daimler AG.

If you have received notification that your vehicle is a part of a recall and / or requires any form of software update relating to engine management systems or emissions, you may have a case for compensation.

You should be informed by Mercedes if you are affected, with their website advice confirming as follows:

“If a vehicle is affected we will inform our customers as soon as the relevant software updates are available and it is possible to install them in our dealerships.”

In the same way that we have been pursuing claims for victims of the VW emissions scandal, if things like residual values and vehicle performances are adversely affected following alterations to your vehicle, you could claim for any losses incurred. Although further investigation into the Mercedes emissions scandal is required in terms of the applicable law and the basis of the claim itself, we are looking to pursue cases for:

  • Breaches of contract against the dealership and / or against the manufacturer financier;
  • Breaches of the (amended) Consumer Protection from Unfair Trading Regulations 2008 ("CPUT") against the dealership and /or the manufacturer financier.

Where the “CPUT” regulations apply, victims could be eligible to claim from 25% up to 100% of the purchase price of the vehicle. The price of a brand-new E-Class Saloon is £38,550.00 according to the UK website for Mercedes-Benz, so victims could be entitled to tens of thousands of pounds in damages.

About The Mercedes-Benz Emissions Recall

Mercedes emissions software updates have been applied to vehicles across Europe following a “voluntary service action” that started in 2017 and has so far involved around 3 million diesel vehicles.

German regulator the KBA (German Federal Motor Transport Authority) concluded hearings in Germany whereby vehicles fitted with certain diesel engines may not be complying with European emissions standards. It has been alleged that engine management software may have been manipulating emissions in an illegal way, which is similar to what VW were caught out for.

Information from Daimler’s website states that:

“A software update for the engine management of your vehicle will be carried out. We are developing a total of several hundred versions for the service actions we announced in 2017 for more than three million vehicles.”

Vehicles including Saloons, SUVs and Vans fitted with both Euro 5 and Euro 6 engines may be affected, with prosecutors saying that there had been a “negligent violation of supervisory duties” by Mercedes / Daimler.
